PYRAMID LAKE PAIUTE TRIBE

HUNTING AND FISHING REGULATIONS

SECTION 1: DEFINITIONS

1.01 BAIT. "Bait" means any animal or vegetable substance, including, but not limited to crayfish, fish, fish eggs, frogs, salamanders, waterdogs or worms, used for the purpose of fishing.

1.02 BIRD. "Bird" means any wild or feral bird.

1.03 CHUMMING. "Chumming" means the placing in the water fish, parts of fish, or other material upon which fish feed, for the purpose of attracting fish to a particular area in order that they may be taken.

1.04 FISH. "Fish" means any species of aquatic fin fish in any stage of the life cycle found or introduced into the reservation.

1.05 TO FISH. "To Fish" and it's derivatives "fish", "fishing", "fished", etc., mean any effort including every attempt to take and every act of assistance to any other person in taking or attempting to take fish in the waters on the reservation.

1.06 HOOK. "Hook" or "fish hook" means any implement to catch or hold fish. "Single hook" means any hook with one point, with or without a barb: "Double hook" means any hook with two points, with or without barbs, attached to a single shank; "Treble or triple hook" means any hook with three points, with or without barbs, attached to a single shank. "Snag" or "Gaff" hooks are hooks with or without handles used to take fish in such a manner that the fish does not take the hook voluntarily in its mouth

1.07 TO HUNT. "To Hunt" and its derivatives "hunt", "hunting", "hunted" etc. mean any effort to take any bird or mammal, including every attempt to take and every act of assistance to any other person in taking or attempting to take birds or mammals.

1.08 LEGAL TACKLE. "Legal Tackle" means a hook and line attched to a rod and reel held in hand while landing fish.

1.09 MAMMAL. "Mammal" means any wild or feral mammal.

1.10 OPEN WATERS. "Open waters" means any waters within the exterior boundaries of the Reservation not designated as closed waters under Section 5, below.

1.11 RESERVATION. "Reservation" means the Pyramid Lake Reservation as depicted by the official Master Title Plot Map of the U.S. Bureau of Land Managenment, Reno, Nevada.

1.12 SNAGGING. "Snagging" means any activity whereby an effort is made to hook a fish in any part of its body other than its mouth by constant jerking of a hook or hooks attached to a line, pole, rod or other device.

1.13 TO TAKE. "To take" and its derivatives "taking" and "take", including pursuing, shooting, hunting, killing, or capturing, trapping, snaring and netting birds, fish and mammals, and all lesser acts such as disturbing, harrying or worring, or placing, setting, drawing or using any net or other device commonly used to take any such animal, and any attempt to do any of the foregoing.

1.14 TOTAL LENGTH. "Total length" means the length of any fish, measured as the distance between the tip of the nose and the fork of the tail.

1.15 TO TRAP. "To trap" and its derivatives "trap", "trapping", "trapped", etc., mean taking, killing and capturing any bird or mammal with traps, deadfalls and other devices commonly used to take such animals, and the shooting or killing of such animals lawfully trapped, and includes such lesser acts such as placing, setting or staking such traps, deadfalls or other devices whether they result in taking or not, and every attempt to take and every act of assistance to any other person in taking or attempting to take such animals with traps, deadfalls or other devices.

1.16 TRIBAL COUNCIL. "Tribal Council" means the Pyramid Lake Paiute Tribal Council.

1.17 TRIBAL MEMBER. "Tribal Member" means any person whose name apears on the records of the Tribe as an enrolled member of the Tribe.

1.18 TRIBE. "Tribe" means the Pyramid Lake Tribe of Indians.

1.19 GUIDE. Any person(s) engaged in the business to manage, supervise, conduct, direct, lead, steer, escort, pilot, show, control, affect, influence, or regulate, another person(s) in sport fishing for monetary gain.

SECTION2: HUNTING AND TRAPPING

2.1 FIREARMS. No firearms are permitted to be transported by non-Tribal members onto the Reservation or possessed or used by non-Tribal members within the exterior boundaries of the Reservation.

2.2 HUNTING. Hunting by non-Tribal members within the exterior boundaries of the Pyramid Lake Indian Reservation is prohibited. The hunting of Bighorn sheep (all species) by Tribal members within the exterior boundaries of the Reservation is also prohibited. All other hunting by Tribal members within the exterior boundaries of the Reservations is regulated by the Tribal Council by seperate resolution.

2.3 TRAPPING. Trapping by non-Tribal members within the exterior boundaries of the Pyramid Lake Indian Reservation is prohibited. Tribal members may trap birds or mammals within the exterior boundaries of the Reservation under such regulations as the Tribal Council may prescribe.

 

Section 3: Fishing

Prohibited Methods for Non-Tribal Members

3.1 Illegal Tackle.

3.1.1 It shall be illegal, except where expressly permitted, to fish from or in any of the waters of the Reservation for any fish with any seine, net, spear, setline, set hooks, grabhooks, trotline or snagline, or in any manner known as snagging, or with any weir fence, trap, giant powder, or nay other manner other than the act of fishing with legal tackle for personal use and not for barter or sale.

3.1.2 Only one combination of rod, line and no more than two hooks (as defined in section 1.6 above) which hooks shall be barb less, shall be used by one person at a time and equipment shall be closely attended by such person while fishing.

3.2 Chumming. Chumming is prohibited within the exterior borders of the Reservation.

3.3 Snagging. Snagging is prohibited whithin the borders of the reservation. Possession of fish that have hook marks in any area of the body other than the head or mouth shall be prima facie evidence of snagging.

3.4 Bait Fishing. The use of bait for fishing in the waters on the Reservation is prohibited.

3.5 Stringer Restrictions. It shall be unlawful to have more than one trout on a stringer while fishing. There shall be a limit of one stringer per person. For purposes of this section, stringer is defined to be any piece of string, line, or rope, whether metal, plastic, fabric or otherwise, or similar material utilized by fisherman to string and keep fish in their possession in the water while fishing.

3.6 Use Of Milkcrates, Etc. Any milk crates, boxes or other objects used in the water as a fishing aid must be occupied by the fisherman at all times while in the water. Any person who leaves such objects in the water shall be deemed guilty of littering. Milk crates and other such objects must be taken out when the person using those objects leaves the water.

Section 4: Fishing Season

4.1 Season: Due to spawning season the open waters of Pyramid Lake shall be open to fishing year round, with the exception of Trout Season, which shall be open from October 1 to June 30 of each year. From March 15 to May 16, closed areas are from the Sutcliffe Marina up to and including the South Nets Beach area. Fishing within 500 feet of all boat docks is prohibited.

SECTION 5: CLOSED WATERS

5.1 TRUCKEE RIVER AND MARBLE BLUFF FISHWAY

5.1.1 TRUCKEE RIVER. The Truckee River from Numana Dam to Pyramid Lake shall be closed to Fishing by non-Tribal members, and further, shall be closed to fishing by Tribal members from February 1 through and including May 31.

5.1.2 MARBLE BLUFF FISHWAY. The Marble Bluff Fishway for its entire length and that portion of Pyramid Lake within a 600 foot radius around the mouth of the Marble Bluff Fishway, shall be closed to fishing.

5.2 FISH PENS AND REARING FACILITIES

5.2.1 FISH PENS. The fish pens located in the Sutcliffe aarea shall be closed to fishing.

5.2.2.FISH PEN AREA. Fishing is prohibited within a 1,000 foot radius around the fish attraction channel at the fish pens located in the Sutcliffe area.

5.2.3. REARING FACILITIES. Fishing in any facilities, including but not limited to fish hatchery facilities, ponds or raceways, utilized for the purpose of rearing fish within the exterior boundaries of the Reservation, is prohibited.

SECTION 6: FISHING HOURS

6.1 FISHING HOURS. One hour before sunrise to one hour after sunset.

 

Section 7: Size, Catch & Possession

Limits For Non-Tribal Members

7.1 Size Limit The total daily trout limit is 2 FISH: 1. Legal size is 16" to 19", and 24" & longer; 2. Only 1 fish over 24" allowed in possession; 3. No fish less than 16", or between 19" and 24" allowed in possession (in order to protect more larger fish for spawning and to produce more trophy size fish).

7.2 Catch And Possession Limits

7.2.1 Trout Or Salmon. Two trout or salmon or combination thereof per day, not to exceed four in possession.

7.2.2 Sacramento Perch. Ten Sacramento Perch per day, not to exceed ten in possession.

7.2.3 Cui-ui fishing closed to all non-Tribal members.

7.2.4 Cui-ui fishing by Tribal Members is regulated by the Tribal Council under separate resoulution.

7.3 Other Fish. There are no size, catch or possession limits for fish not mentioned above.

SECTION 8: FISHING TACKLE

8.1 Only legal tackle shall be used by non-Tribal members within the exterior boundaries of the Reservation.

SECTION 9: LICENSE REQUIREMENTS

9.1 Non-Tribal Members. All non-Tribal members, except as set forth at Section 9.3 below, 12 years of age or older must have in their possession a valid Tribal Fishing Permit to fish in open waters within the exterior boundaries of the reservation.

9.2 Tribal Members. All Tribal Members over 12 years of age fishing on the Reservation must have in their possession and on their person while fishing either a validly issued and authorized Tribal Membership identification card or a special fishing permit.

9.3 Spouses. A non-Tribal member married to a Tribal Member may apply to the Tribal Council for a complimentary Tribal Fishing Permit. If no Tribal Fishing Permit is obtained, A non-Tribal member married to a Tribal Member shall be subject to the same regulations as govern other non-Tribal members.

9.4 Tribal Fishing permit fees shall be as follows:

Daily Fishing Permit: $9.00 Annual Fishing Permit: $74.00

9.5 Lost Or Stolen Permits. The Tribe shall not be responsible for lost or stolen permits. Persons whose permits are lost or stolen must, at their own expense, obtain a new permit and pay the applicable fee. For purposes of Section 9.1 above, it shall not be a valid defense for failing to have in their possession that the permit was lost or stolen.

SECTION 10: RELEASE OF WILDLIFE

Except as authorized by permit, license or other entitlement lawfully and validly issued by the Tribal Council, and after inspection of the matter sought to be planted, it shall be unlawful for any person to plant any fish, fish fry, spawn or any aquatic plant in any waters within the exterior boundaries of the Reservation, or to release any mammals or birds on any land within the exterior boundaries of the Reservation.

SECTION 11: CREEL CENSUS

Subject to the provisions of 25 U.S.C., Section 1302, it shall be unlawful for any person to refuse or fail to answer all questions relating to this fishing activity on the waters of the Reservation asked by any person (a) authorized by the Tribal Council to enforce the provisions of the Pyramid Lake Hunting and Fishing Ordinance and these regulations or (b) authorized by the Tribal Council to engage in scientific reseach, propagation of fish and the stocking of Reservation water therewith.

SECTION 12: ENFORCEMENT

12.1 VIOLATIONS, CIVIL FINES. Any person who violates any provision of the Tribe's fishing regulations shall be subjct to a civil fine for each such offense, and shall be required to pay a fine of not less than $25.00 nor more than $500.00 for each such offense.

12.2 REPORTS OF VIOLATIONS. Reports of alleged violations of the provisions of the Tribe's fishing regulations may be made at the Ranger Station during regular business hours. Reports outside of business hours may be made to a hotline, which shall be established by the Tribe to aid in the enforcement of these fishing regulations. When implemented, the number for said hotline shall be displayed prominently within the general information handbook containing the Tribe's fishing regulations and at other such places as the Tribe or Tribal Ranger designates.

BOATING REGULATIONS

SECTION 1: DEFINITIONS

1.1 BOAT "Boat" means any vessel or watercraft moved by oars, paddles, sails, or other power mechanism, inboard or outboard, or any vessel or stucture floating on the water, whether or not capable of self-locomotion, including but not limited to houseboats, barges and similar floating objects; provided, that boat does not include float tubes, small rafts, sail boards,or any other small flotation device used solely for single person recreation.

1.2 CLOSED WATERS. "Closed waters" means any lake, river, stream, body of water or any part thereof, within the Reservation described or designated wherein it shall be unlawful to operate a boat.

1.3 COUNCIL. "Council" means the Pyramid Lake Paiute Tribal Council.

1.4 MEMBER. "Member" means any person whose name appears on the records of the Tribe as an enrolled member of the Tribe.

1.5 MOTORBOAT. "Motorboat" means any boat that is not a sailboat as defined at subsection 1.10, below.

1.6 OPEN WATERS. "Open Waters" means any waters within the boundaries of the Reservation not designated as closed waters.

1.7 OPERATE. "Operate" and its derivatives " operating" and operated", etc., mean to cause, bring about or effect the propulsion of any boat on the waters of the Reservation.

1.8 PERSON. "Person" means any individual, Indian or non-Indian, partnership, joint stock company or corporation.

1.9 RESERVATION. "Reservation" means the Pyramid Lake Indian Reservation as depicted by the official Master Title Plot Mapof the U.S. Bureau of Land Management, Reno, Nevada.

1.10 SAILBOAT. "Sailboat" means any boat whose primary means of propulsion or movement is by action of the wind, rather than by motor, engine or other mechanical or physical device.

1.11 SEWAGE. "Sewage" means any waste material or discharge, liquid or solid, including but not limited to human body wastes and discharges from sinks, showers, fuel tanks or bilge tanks.

1.12 TRIBAL GAME WARDEN. "Tribal Game Warden" means any person duly authorized by the Council to enforce the provisions of these Reglations.

1.13 TRIBAL COURT. "Tribal Court" means the Pyramid Lake Paiute Tribal Court.

1.14 TRIBE. "Tribe" means the Pyramid Lake Paiute Tribe of Indians.

SECTION 2: CLASSIFICATION OF BOATS

2.1 Motorboats subjct to the provisions of these Regulations shall be divided into four classes as follows:

2.1.1 CLASS A: Motorboats less than 16 feet in length. (Jet skis included)

2.1.2 CLASS 1: Motorboats 16 feet or more in length bu less than 26 feet in length.

2.1.3 CLASS 2: Motorboats 26 feet or more in length but less than 40 feet in length.

2.1.4 CLASS 3: Motorboats 40 feet or more in length.

SECTION 3: BOATING EQUIPMENT

3.1 LIGHTS.
